Judges most often apply the law appropriately and juries usually take their responsibilities seriously and genuinely try to decide cases properly. However, if we feel an error of law does occur at trial and that error provides grounds for an appeal, we offer clients the option to file the case at the appellate court level. Appellate trials are not a retrial of the case with all the witnesses and presentation of factual evidence. Appeals focus on whether the judge appropriately applied the law with regard to ruling on motions, instructing the jury, and excluding improper evidence. While trying a case we always make an effort to preserve arguments in the trial record supporting our client’s side so the necessary documentation will appear if the case is appealed. Although only a small proportion of cases progress to the appeals court, we are willing to challenge the opposition’s position at that level if that is what our client directs.
